Una vez superada la auditoría el dinero "prestado" volvió al Casino del Hotel Hermitage. Menéndez no sabía que todo fue registrado con detalle por las propias cámaras del Casino, lo cual dio inicio la causa. El traslado de la gran cantidad de billetes se realizó en horas de la noche, en forma subrepticia y justamente en una mochila verde que nada tenía de oficial.
