Acude a la Delegación de Hacienda más cercana con dicha reclamación y su copia, y las pruebas que tengas. Preséntalo en el Registro y que te devuelvan tu copia sellada. Si vives en Madrid puedes acudir directamente a la DGOJ en la Calle Atocha, 3, 2ª Pl. Si en tu ciudad no hay una Delegación de Hacienda, no hay problema alguno, ya que puedes presentar la documentación en muchos otros lugares, como indica la Ley del RJAPyPAC: • Los registros de cualquier órgano administrativo que pertenezca a la Administración General del Estado • Los registros de cualquier órgano admnistrativo que pertenezcan a las Administraciones de cualquier Comunidad Autónoma • Los registos de las Entidades locales que hayan suscrito el oportuno convenio de colaboración. • En las oficinas de Correos, en la forma que reglamentariamente se establezca. • En las representaciones diplomáticas u oficinas consulares de España en el extranjero. • En cualquier otro que establezcan las disposiciones vigentes. Si dispones de DNI electrónico es posible que puedas presentarla por internet, pero como yo no tengo, no puedo deciros exactamente cómo. Existe cierta libertad de forma a la hora de redactar, ya que siempre que del escrito se desprenda claramente cuál es su finalidad, dará lugar a la incoación del procedimiento correspondiente. Son requisitos imprescindibles: - el nombre y apellidos de la persona que formula la solicitud (y, en su caso, de su representante), - lugar de notificaciones, - lugar y la firma del solicitante, - hechos, razones y petición en que se concrete la solcitud, y - el órgano, centro o unidad administrativa a la que se dirige. Yo recomiendo algo sencillo, como por ejemplo: -En la parte superior identifícate correctamente, ya que como parte interesada del procedimiento se te enviarán notificaciones, y podrían ponerse en contacto contigo para aclarar algo o requerirte más información. -A continuación expón lo que te ha ocurrido, de forma clara y ordenada. -Y antes de acabar, escribe claramente lo que solicitas. -No olvides firmar el documento. -En la parte inferior indica a quien va dirigido el escrito. -Procura no cometer faltas de ortografía, y que la presentación sea agradable (márgenes suficientes, párrafos cortos,…). Recuerda que existen comas, puntos,… -Utilizad las hojas que necesitéis (pero sin extenderos innecesariamente). Yo en este ejemplo uso solo 1 por comodidad. -Si conoces exactamente que normativa se ha infringido puedes incorporar un apartado con los Fundamentos de derecho (entre la exposición y la solicitud), aunque si no lo sabes a ciencia cierta, no es imprescindible (ya que quienes han de resolver tu reclamación conocen la legislación vigente) 4. Esperar Una vez presentada la reclamación se inicia el correspondiente procedimiento administrativo, sin necesidad de más intervención por tu parte. Como parte interesada que eres, se te notificará la resolución o cualquier otra información relevante. Nunca tengáis miedo a reclamar, si habéis sido estafados y tenéis pruebas de ello, pero tampoco reclaméis por reclamar si no tenéis razones para hacerlo. Hay que ser justos.
